Subclass 444 Visa Success
The Visa holder came to Australia on a Subclass 444 visa when he was a child, and has lived here ever since.
The subclass 444 visa is a special category visa which allowed the visa holder to stay and work in Australia as long as he remained a New Zealand citizen.
The visa holder received a Notice of Intention to Consider Cancellation of his 444 visa on character grounds, and came to Immigration Solutions Lawyers (ISL) seeking help as it was likely the visa would be cancelled. He had a criminal record in Australia and had received a formal warning previously.
The visa holder and his partner met in 2013, commenced a relationship and a short time after the couple had their first child. Both the visa holder’s partner and child are Australian Citizens.

We argued that if the visa holder was to have his visa cancelled it would not be in the best interest of the child and the Australian partner. If his subclass 444 visa were cancelled it would prohibit him from entering the country again. ISL indicated that this would cause both financial and emotional hardship for the family.
ISL also argued that although the visa holder did not meet the character requirements due to his criminal record, he was in the developmental stages of life when he obtained the record and he has had the opportunity to change since then.
After providing all the necessary information and compiling compelling evidence of the relationship, ISL was successful in securing the non-cancellation of the subclass 444 visa.
