Resident Return (Subclass 155) Visa with a PIC 4020 Character Submission.
CASE TYPE
The Applicant who had resided in Australia since 2010, has a wife and two children who are Australian born and contracted Immigration Solutions Lawyers for the lodgement of his Resident Return Visa and for the preparation of a PIC 4020 Character Submission.
CASE BACKGROUND DIFFICULTY
The Applicant had mistakenly failed to disclose his previous deportation and was required to now disclose this in his Resident Return Visa. The level of difficulty when addressing a Public Interest Criterion 4020 is high, given that the Applicant did not disclose this information in numerous visa applications and a failure to disclose is a serious issue which the Department do not take lightly. The Applicant also had traffic offences.
CASE STRATEGY
We advised the Applicant to make full disclosure through attaching a Character Submission to his Resident Return Visa Application. In this Character Submission we found it crucial to detail the Applicants ties to Australia, his lack of understanding of his Deportation and its legal consequences and reiterated his remorse for the matter. We also addressed the Applicants previous driving offences and displayed mitigating factors including his age, the period lapsed between now and the offence, etc. We also ensured the providing of all relevant and required documentation to support our legal particulars.
CASE OUTCOME
The Department granted the Resident Return Visa to the Applicant within 48 Hours of lodgement.
