However, they later separated after having relationship problems and they eventually divorced. They had two children together during their marriage. The Sponsor later met his second partner and sponsored her for a 309 Spouse visa, but his second partner also abandoned him. The Sponsor then entered into a de facto relationship with an Australian citizen and he had his third child with her but they later separated. The Sponsor then met the Applicant on a dating website and their relationship began almost immediately. They established a long distance relationship and met each other in person overseas nine months later. They were married shortly after and lodged a Partner visa application together.</p><p>The Partner visa application was refused due to regulation 120J; the sponsor had already sponsored his previous two partners and was restricted from sponsoring a third partner. However, this limitation can be waived if the sponsor can demonstrate that there were compelling &#8216;circumstances&#8217; present at the time of the visa application. The delegate unfortunately was not satisfied that there were compelling circumstances affecting the sponsor which would enable approval. The delegate stated that the Sponsor&#8217;s relationship with the Applicant was not long-standing, and noted that the sponsor had not travelled to visit the Applicant since their marriage. The Sponsor&#8217;s request for a waiver appeared to be based solely on his claims that he had made bad relationship choices in the past. Therefore the delegate concluded that there were no compelling circumstances that warranted a waiver of the sponsorship limitation.</p><p>An application was made to the Migration Review Tribunal (&#8216;MRT&#8217;) to review the refusal of the decision, and Immigration Solutions Lawyers (&#8216;ISL&#8217;) took over the matter and handled the MRT lodgement. The Sponsor was invited to provide information regarding his compelling circumstances in order to waive the 120J requirement. The compelling circumstances were that the Applicant&#8217;s first spouse abandoned him and his children on two separate occasions and then for a final time. After the first spouse abandoned him, the Sponsor was driving and was rammed by another driver who was the person with whom his first partner was having an affair. The Sponsor was hospitalised, suffered post-traumatic stress disorder and had to resign from his job. The second time that the Applicant&#8217;s first spouse abandoned him he went through a property settlement and custody battle which caused him severe stress and mental health issues. When his second partner left him his mental health and depression deteriorated further. He then became involved in a de facto relationship with an Australian citizen for five years but this ended with the de facto partner leaving him and taking their child which again contributed to the deterioration of his mental health. The Sponsor would also not be able to leave Australia to live with the Applicant overseas because he is responsible for caring for his two children as well as his elderly parents.</p><p>The Sponsor did not misuse migration provisions in the past and the Tribunal was satisfied that the Applicant was in a genuine and continuing relationship with the Sponsor. Therefore they only had to consider whether there were compelling circumstances that enabled the waiver. The Sponsor was unaware at the time he married the Applicant that sponsorships were limited and he only discovered the limitation a year after his spouse lodged her application.</p><p>ISL was successful in securing the waiver; the Tribunal remitted the decision for reconsideration with the direction that the 120J requirement was waived.</p>						</div>

							<p>The Applicant lodged a protection visa, although he had already met the Sponsor. The Applicant and Sponsor then married, and after this the Applicant&#8217;s protection visa was refused. The Applicant then lodged an application for a Partner visa on the grounds of being in a spousal relationship with an Australian citizen.</p><p>The Department refused to grant the Partner visa. The Applicant then applied to the MRT for review of the delegates&#8217; decision. A hearing was scheduled with the MRT, however the Applicant and Sponsor attended alone as their migration agent failed to attend. Immigration Solutions Lawyers (&#8216;ISL&#8217;) was instructed to act for the client in relation to the MRT after the hearing had taken place. The MRT then affirmed the decision to refuse the Partner visa.</p><p>The Applicant applied for Ministerial intervention and lodged a complaint with OMARA concerning the conduct of his previous Migration Agent. The Minister intervened in the Applicant&#8217;s case and granted him a 676 visa with work rights to enable the Applicant to lodge a Partner visa. However, the Partner visa was refused and the Applicant made an application for a review to the MRT. The refusal was based on the Applicant&#8217;s visa history and the Department had reached the view that the Applicant and Sponsor were not in a genuine and continuing relationship.</p><p>ISL submitted that the Applicant provided a substantial amount of evidence to prove the genuineness of his relationship with the Sponsor, and that the Applicant would provide further evidence of their relationship such as evidence of their joint residence and joint bank account.</p><p>ISL successfully secured the grant of a Partner visa.</p>						</div>

							<p>The visa applicant and review applicant came to Immigration Solutions Lawyers (ISL) seeking help with a refused Subclass 116 Other Family (migration) application.</p><p>The review applicant was seeking assistance from the visa applicant to care for an Australian citizen family member. No family members residing in Australia had the ability to care for the family member who had medical issues.</p><p>The Migration Review Tribunal (MRT) refused the application on the grounds of unsatisfactory information and based on a witness whose credibility was in doubt. ISL then made a request under Section 351 of the Migration Act to the Minister.</p><p>Very comprehensive submissions were made and updated material was provided to assist in a full consideration of the material to the Minister. ISL was able to provide the appropriate documentation to illustrate the existence of strong compassionate circumstances. Without assistance from the visa applicant, irreparable harm and continual hardship would be inflicted on the Australian citizen family member who required assistance. The immigration team at ISL also drew on the family member&#8217;s age and health concerns as a significant reason of the visa applicant to be granted a Subclass 151 Former Resident visa.</p><p>ISL was successful in obtaining a Subclass 151 Former Resident Visa. 							<p>The applicant had first arrived in Australia in 2010 on a Working Holiday Visa. The following year the applicant lodged an application for the 457 Visa. The visa application was refused because the applicant did not have the relevant skills or qualification for the nominated occupation.</p><p>Between 2011 and 2013 a preliminary submission to MRT was made, a successful nomination for the applicant&#8217;s sponsoring company was produced and the applicant&#8217;s skills and qualifications were presented to the proper skills assessment authority. In November 2013, ISL submitted details on the applicant&#8217;s skills and qualifications demonstrating that the applicant had now satisfied all requirements.</p><p>A decision was made on the papers by MRT without a hearing and the case was remitted back to DIBP for the grant of the visa.</p>						</div>

There was a concern for the applicant&#8217;s emotional and psychological well-being.</p><p>The case was remitted back to DIBP for the grant of the visa.</p>						</div>

							<p>The applicant in this case was seeking to satisfy the criteria for the grant of a Subclass 836 (Carer) visa. The delegate had refused to grant the visa on the basis that one of the criteria was not met; whether the sponsor was a settled resident at the time of lodgement. Therefore Immigration Solutions Lawyers (ISL) took the case to the Migration Review Tribunal. The issue was whether the applicant was the carer of an Australian relative who was settled in Australia.</p><p>The applicant claimed to be the caree&#8217;s mother, and the Tribunal was satisfied that this was correct. However, the Tribunal also had to determine whether the caree was settled at the time of lodgement. The meaning of settled‚ is lawfully resident in Australia for a reasonable period. Under departmental guidelines, two years is generally considered to be a reasonable period, however each case must be considered on an individual basis. The caree had been lawfully living in Australia for over two years, but was in Australia for a reasonably short period of time before she lodged an application to sponsor her son to be her carer. This short period of time was of concern to the Tribunal. When examining the facts of the case, it became clear that the caree had successfully sought a protection visa, was suffering from a serious medical situation and was unable to care for herself and unable to travel. The tribunal took into account the compassionate and compelling circumstances, namely her being a refugee and her medical conditions, and found that she was a settled permanent resident.</p><p>The assistance provided by the carer also must not have been able to be reasonably provided by: any other relative of the Australian relative who is an Australian citizen, permanent resident or an eligible New Zealand citizen; or obtained from welfare, hospital, nursing or community services in Australia. ISL submitted that the caree did have other children in Australia but they could not reasonably have assisted their mother. One was a single parent with multiple children who was not physically able to assist the caree, and the other was studying and working as well as caring for his own children. ISL also submitted that the caree could also not access welfare, hospital, nursing or community services in Australia because she did not want persons other than her family looking after her. There were also no care facilities in the caree&#8217;s area that could cater to her cultural needs. As such, the Tribunal found that it would not be reasonable for her to be placed in high level residential care.</p><p>The Tribunal found it was appropriate to remit the application for the visa for reconsideration.</p>						</div>

							<p>This case involved a decision on a refused Partner visa application. The applicant applied for the visa on the basis of their relationship with his sponsor who is an Australian citizen. The delegate refused to grant the visa due to the fact that they were not satisfied on the evidence provided that the applicant and sponsor were in a spousal relationship. The applicant applied for a review of the decision to the Migration Review Tribunal.</p><p>Immigration Solutions Lawyers (ISL) provided a detailed submission on behalf of the applicant with further evidence that provided a background to the application and an explanation of the applicant&#8217;s experiences with his previous migration agent who failed to advise him of the evidentiary requirements relevant to his application and who also failed to inform him about the Department&#8217;s requests for further information. ISL provided more evidence concerning the applicant&#8217;s financial, commitment, social and household aspects of the relationship at time of the application. The submission also argued that there were compelling reasons for not applying the Schedule 3 criteria.</p><p>The issue in the present case was whether the applicant and sponsor were in a spousal relationship at the time of the application and at the time of the decision, and additionally, whether there were compelling reasons not to apply the Schedule 3 criteria. Having regard to the totality of the evidence before it, the Tribunal decided that the applicant and sponsor were genuine spouses. However, its decision in relation to whether the Schedule 3 requirements could be waived was more complex. This was because, as the Tribunal noted, it had to be mindful of the revised policy guidance issued on the 1<sup>st</sup> of July 2014. However, the Tribunal emphasised that Department policy is not binding on the Tribunal and that the Tribunal is not limited to only consider the circumstances identified in the policy but rather is obliged to consider <em>all</em> the circumstances of the case. This includes any matters put forward by an applicant and involves the Tribunal making a determination on the evidence as a whole as to whether there are compelling reasons.</p><p>Prior to the policy changes, ISL had submitted a number of compelling circumstances for the Tribunal to consider; the long standing nature of the parties relationship, significant emotional hardship on the sponsor as a result of her reliance on the applicant for emotional support as she had no other close family members in Australia, the applicant and sponsor had been seeking to have a baby for the past few years and were exploring fertility issues, emotional hardship and risk of physical harm to the applicant if he were forced to separate from the sponsor and return to his home-country, financial hardship on the applicant and sponsor if forced to return, and security issues for both the applicant and sponsor if required to return to the applicant&#8217;s home country.</p><p>The Tribunal accepted the list of compelling circumstances, was satisfied that they were compelling reasons and as such waived the Schedule 3 criteria. The Tribunal then decided to remit the application to the Department of Immigration and Border Protection.</p>						</div>

							<p>The applicant is a citizen of Indonesia who had been granted a visitor visa in 2009. During that time, she was employed to provide full-time care to an impaired nine year old child, cohabiting with his family.</p><p>Driven by a desire to address the lack of care options available in her home country, the applicant sought to study Disability and Community Service courses in Australia. Accordingly, she applied for a subclass 572 student visa. This was refused by the Department of Immigration and Citizenship, which found that she was not a genuine student&#8217; due to her substantial care responsibilities for the child.</p><p>ISL was instructed to appeal this decision to the Migration Review Tribunal. We were successful in establishing to the Tribunal that the applicant was a genuine student&#8217; by demonstrating an improvement to the child&#8217;s health , which had alleviated the applicant&#8217;s care responsibilities. Further, we submitted evidence of the applicant&#8217;s genuine passion for her chosen area of study, as demonstrated not only by her enrolment in relevant educational courses, but also her paid and volunteer work in the field.</p><p>Upon this evidence, the Tribunal decided to overturn the Department&#8217;s decision to refuse the student visa.</p>						</div>

							<p><strong><em>Visa granted </em></strong></p><p>The applicant, a citizen of South-East Asia, applied for a Partner Visa sponsored by her husband, an Australian citizen. This, however, was her husband&#8217;s third sponsorship of a spouse. As such, the application was caught by regulation 1.20J of the Migration Regulations 1994 which required a five-year period between the making of the second and third sponsorships, in the view of deterring serial sponsors. The Partner Visa application was refused by the Department of Immigration and Citizenship (the DIAC) on this basis.</p><p>ISL was instructed to appeal the DIAC&#8217;s decision to the Migration Review Tribunal (the MRT). To circumvent the restrictions of regulation 1.20J, we had to show that there were &#8220;&#8221;compelling circumstances&#8221;&#8221; affecting the sponsor.</p><p>We submitted to the Tribunal that the applicant and sponsor&#8217;s long-standing relationship, their desire to have a child through IVF (an opportunity which would be missed should the applicant&#8217;s visa status remain uncertain) and the sponsor&#8217;s requirement of emotional and financial support constituted such &#8220;&#8221;compelling circumstances&#8221;&#8221;.</p><p>Taking this combination of factors into consideration and accepting the genuineness of the applicant and sponsor&#8217;s relationship, the Tribunal was satisfied that these circumstances warranted the waiver of regulation 1.20J, thus allowing the Partner Visa to be granted.</p>						</div>

							<p><strong><em>Visas granted </em></strong></p><p>The applicant made an application for a Partner Visa in 2011. The application was refused by the Department of Immigration &amp; Citizenship because the applicant&#8217;s sponsor had sponsored more than two partners in his time. His first sponsorship took place in 1987 and the other was made in 2007. Regulation 1.20J of the Migration Regulations sets a limit on the number of people that a person can sponsor in a lifetime and a minimum time that must lapse between each sponsorship.</p><p>After the applicant&#8217;s application for the Partner Visa was refused, ISL was instructed to appeal the decision to the Migration Review Tribunal.</p><p>As two people have already been granted a visa as the spouse of the sponsor on the basis of a sponsorship nomination, and a period of less than five years has passed since the making of the second application, the Tribunal found that the approval of this sponsorship is limited under r1.20J. However, the Tribunal may approve the sponsorship if there are compelling circumstances affecting the sponsor.</p><p>Before the Member, ISL argued that this relationship was a genuine and longstanding one, and provided evidence that the couple wishes to have a family together.</p><p>The Tribunal considered the arguments and evidence put forth satisfied the criteria of compelling circumstances affecting the sponsor‚Äô and has thus remitted the application for a Partner Visa for reconsideration.</p>						</div>
