The Applicant had never visited Australia previously and had lodged two Student Visa’s and a Visitor visas, and subsequently all were refused on the basis that they didn’t satisfy 600.211 of the Migration Regulation 1994(Cth), which essentially set out the Genuine Temporary Entrant requirements.

The main strategy for the new Visitor Visa application was to display to the Department that the Applicant meets Genuine Temporary Entrant requirements on the basis that the Applicants ties to their home country had increased through their property ownership and firm employment.

The Applicant came to Australia on a Subclass 500 Student Visa and initially studied a Master of Business Administration, and applied for a Subclass 189 Visa (after lodging an Expression of Interest), which was refused on the basis that the Applicant had provided misleading and false information in their Expression of Interest application. The Applicant then applied to the Administrative Appeals Tribunal (AAT) for a review of the refusal on Subclass 189 Visa. We made a request for decision on papers to the AAT and the AAT affirmed the decision of the Department.  Given the Applicant had a period of unlawfulness, she was subsequently holding a Bridging Visa E. 

Throughout this process, the Applicant had further completed a Masters in Nursing and had secured employment as an Aged Care Nurse.

We then submitted a Ministerial Intervention Request to the Minister whereby the Minister intervened.

CASE TYPE

The Company who was in the I.T Sector, who wanted to Nominate their current employee under the occupation of Computer Network and Systems Engineer. The Nominator lodged a Subclass 186 Nomination Application, which was refused due to the Nominator’s financial loss which was not adequately addressed. The Subclass 186 (Direct Entry Stream) Visa Applicant then received notification form the Department that their Visa may be withdrawn given the refusal of the employer’s Nomination Application.

The Employer was then advised by their previous Legal Representatives to lodge a review for the Nomination Application to the Administrative Appeals Tribunal.
