The Applicant was applying for a citizenship application with a history of ADVO and a good behaviour bond which was issued less than 10 years before the date of application.
CASE BACKGROUND DIFFICULTY
The Applicant was charged with the offence of Domestic Violence. The Applicant was an employee at a nursing home and previously had no history of a civil or criminal offence. The Applicant was required to show that he is of good character and a fit and proper person and a desirable person to have the privilege of becoming an Australian Citizen.
CASE STRATEGY
We advised the client to obtain a plethora of references displaying his good character from close friends and family and were aware of the criminal offence they was charged with. Additionally, we prepared a legal submission in accordance with the Migration Regulations to demonstrate how the Applicant satisfies the requirements of a good character. We submitted the application with all required supporting evidence in support of the legal submission.
CASE OUTCOME
The Applicant was granted citizenship within a year from the lodgement date without any further request from the Department to present additional evidence to demonstrate the client’s character concern.
