ISL's Compelling Submissions: Genuineness of Relationship, Schedule 3 Waiver, and Character Support for Partner Visa Application
CASE TYPE
The Applicant and Sponsor approached Immigration Solutions Lawyers (ISL) for assistance with their onshore partner (subclass 820) visa application.
The couple initially connected online and subsequently met in person within Australia. During the consultation process, ISL was informed about certain critical factors, including a significant age difference between the Applicant and Sponsor, the Applicant’s history of providing false information on two prior visa applications resulting in a visa refusal, and the Sponsor’s criminal record consisting of two serious convictions, including a sexual offense and a contravention of an AVO, which led to a four-year prison sentence.
CASE STRATEGY
ISL delivered a comprehensive package of three distinct submissions to strengthen the partner visa application.
The genuineness of relationship submission presented compelling evidence showcasing the couple’s unwavering commitment despite their significant age difference. Additionally, we meticulously constructed a thorough submission supported by extensive evidence, aiming to waive the schedule 3 requirements and mitigate any failure to disclose issues (commonly referred to as PIC 4020). Our submissions effectively addressed and outlined the Sponsor’s physical and psychological challenges, supported by robust medical documentation, emphasizing their successful management.
Lastly, a detailed character submission provided ample evidence of the Sponsor’s genuine remorse, considerable time elapsed since completing the sentence, and an assessment of minimal risk of re-offending, fortified by substantial character references. ISL’s well-crafted submissions leave no stone unturned in facilitating a compelling case for the sponsorship application.
CASE OUTCOME
The Department granted the Applicant Subclass 820 visa in January 2023, on account of the applications submissions and exhaustive evidence.
