Notice of intention to cancel visa on character grounds & Section 501 & Successful outcome
The applicant was found to possess pornography by the Australian Federal Police whilst executing a search warrant at the applicant’s home. The applicant was charged and subsequently was convicted to imprisonment for 1 year and 6 months.
This was the applicant’s first offence. Based on our submissions that the applicant would re-offend and his substantial ties to Australia, the applicant’s visa was not cancelled.
The submission included detailed forensic clinical psychological evidence on the issue of conduct and the likelihood of offending.
