Protection Visa (Class XA)
The applicant is a citizen of a central Asian nation who fled their home country to Australia for a three month training with a company against their father’s wishes who had arranged an engagement for the applicant. However, the obstacle was the applicant wanted to apply for assistance, there was a suspension on processing asylum claims from their home country.
If they returned to their home country, they will be a victim of severe torture and physical abused.
We submitted a statement the applicant is a person to whom Australia has protection under the Refugees Convention and is a suitable candidate for the award of subclass 866 Protection visa (Class XA). The applicant well-founded fear of persecution is based on the fact that they were a minority group in their home country, which constitutes a ‘particular social group’ for Convention reasons.
The case is currently pending.
