Renewal of a Resident Return Visa (Subclass 155)

The Applicant came to Immigration Solutions Lawyers to assist her with renewing her Resident Return Visa (subclass 155), which had become problematic due to some character issues.
CASE BACKGROUND DIFFICULTY
The Applicant is a young American who has called Australia home for over a decade. She is a hard worker, and she has established many ties within the Australian community; professionally, socially and economically. Unfortunately, the Applicant was convicted of the criminal offence, which did not involve a custodial sentence.
CASE STRATEGY
In our character submission we submitted that, despite these character issues, the Applicant is a person of good character. We submitted that the offences in question do not constitute a substantial criminal record as defined in s 501(7) of the Migration Act 1958. These instances were extremely out of character. The submission addressed the Applicant accepting full responsibility, her genuine remorse, and her determination to complete all court requirements so that she could put this behind her. We submitted the incredible contributions that the Applicant has made to Australian society. The submission was also supported by a reputable, third-party psychologist report which further strengthened our position that the Applicant is a person of good character.

CASE OUTCOME
We received a positive outcome from the character submission as it sufficiently addressed the character issues. The visa was renewed. This application experienced a fast turnaround. The Application was lodged on 16 June 2022 and the Department renewed the Applicant’s Resident Return Visa (subclass 155) on 23 June 2022. This is not usually the case with addressing criminal convictions in character submissions, which can take a much longer period to process.
