Resident Return Visa: applicant had been outside Australia for more than 5 years
The applicant was refused a resident return visa as she had been outside of Australia for more than 5 years. We argued that the applicant had always considered Australia her home; however due to her husband having an international career she was unable to settle in Australia for most of their married life.
We also argued that the applicant had substantial employment and personal ties with Australia which are of benefit to Australia. We emphasised the applicant’s guaranteed employment should she be granted the visa and outlined the fact that the applicant had formed many close relationships with Australian citizens and had a significant amount of assets in Australia.
The argument was successful and the applicant’s matter was remitted back to the Department.
