Subclass 482 Nomination and Visa Approval.
CASE TYPE
The Company was an Italian restaurant, who wanted to Nominate their current employee as a Cook. The Nominator had previously sponsored their employee in the same occupation however due to COVID-19 Border Closures, the Applicant after visiting family in their home country, was unable to re-enter Australia and reside working under his Subclass 482 Visa.
CASE BACKGROUND DIFFICULTY
The complexity of this Nomination Application and Visa Application came from the Company’s financial difficulties during COVID-19, ensuring that correct and accurate documentation is provided, so as not to delay the assessment process, so the Applicant is able to return to his position in the restaurant and return to Australia and lastly, given the occupation of Cook is on the short-term occupation list, ensuring that we demonstrating the Applicant meets the Genuine Temporary Entrant Requirement given his immigration history in Australia.
CASE STRATEGY
We advised the Company to ensure they display the Genuine Need for the position whilst displaying the Nominee’s experience which benefited the restaurant, and should the position remain open and the negative financial impact it would have on the business if the position was not filled. Additionally, we ensured that a thorough letter was attached at the time of lodgement, detailing the Restaurant’s history and operations currently and ensured all necessary documentation was provided at the time of lodgement, to ensure that the case officer, was able to review the application promptly. Lastly, we also provided a Genuine Temporary Entrant Submission to the Applicant’s Visa Application at the time of lodgement, evidencing their ties to the home country, to demonstrate that they will be in Australia temporarily.
CASE OUTCOME
The Department granted the Company’s Nomination and the Applicant’s Visa, and the Visa Applicant was therefore able to finally return to Australia after being absent for 2 years.
