The importance of transition from 820 to 801 partner visa. Attention to detail is essential in the preparation of the 2nd stage submission.

The Applicant and Sponsor had sought the assistance of Immigration Solutions Lawyers 2 years earlier to lodge their Subclass 820 Partner visa. The Sponsor and Applicant had met when the Applicant was traveling Australia and entered into a genuine and committed relationship. Shortly after the relationship flourished and the couple commenced cohabitation. The couple entered into a committed de facto relationship and came to rely on one another both emotionally and financially to the exclusion of anyone else.

ISL was able to compile the necessary compelling evidence to prove that the Applicant and Sponsor were in a genuine and committed relationship. ISL was able to obtain a successful Subclass 820 Partner Visa grant within 2 weeks of lodgement.

Two years after the Subclass 820 Partner Visa was granted the Applicant and Sponsor were informed that they were eligible to apply for a Subclass 801 Permanent Partner Visa.

This visa is for persons in Australia seeking a permanent visa on the basis of being the partner of an Australian citizen, an Australian permanent resident or eligible New Zealand citizen.

Under the two-stage partner visa, applicants can apply on the one combined application form for both a temporary 820 visa and a permanent 801 visa. This means that a subclass 820 visa holder is usually required to wait two years before their 801 visa application is able to be finalized.

In order to be eligible for a subclass 801 visa applicants must be able to satisfy the following criteria:

– They must hold a subclass 820 visa;
– They must continue to be sponsored;
– They must still be the sponsor’s partner; and
– Two years must have elapsed since the lodgment of the subclass 820 visa.

Immigration Solutions lodged a Subclass 801 Permanent Partner visa application as well as providing extensive evidence to the Department of the couple’s longstanding and continuing relationship.

ISL was successful in securing the Subclass 801 Permanent Partner Visa for the couple.
