The applicant last entered Australia in 1981 under the identity of a friend, he has been living in Australia unlawfully since his arrival, which is more than 30 years.
Before the Minister, ISL established that the applicant was highly integrated within the Australian community through his work and his participation with volunteer work. The applicant has also played a significant role in the local community for the past 30 years.
ISL further submitted that the forced repatriation of the applicant would leave a void in the community. The applicant has assumed a position within the community that disperses a substantial cultural benefit to Australia.
The Minister considered that the arguments and evidence put forth satisfied the criteria of unique or exceptional circumstances’ and has thus decided to grant a visa to the applicant.
